Terms of Service (Terms and Conditions of Use)

Please read these terms of use carefully in its entirety before using the site or any service offered therein. By using the site or otherwise accessing or using our services, you agree to the terms of service and privacy. If you do not accept the terms of use or any provision therein. Do not access the site or use the services.

Throughout the following terms of service, Coinsave Services may be referred to as "us", "our", "we", "the website", "Company", "Coinsave.io" and "Coinsave". Users of Coinsave include but are not limited to registered members, as well as any visitor who uses the website in any way, shape or form. The term cryptocurrency may be used to describe any form of digital currency, including but not limited to Bitcoin and Ethereum.

Again, by using Coinsave, accessing the website, or using any service provided by Coinsave, you agree to the following terms of service and privacy policy. Continued use of the Coinsave website demonstrates that you agree with our terms of service.

  1. You accept both the Terms of Service and the Privacy Policy
    1. These policies were last updated and are effective as of July 10th, 2018. From time to time, and at our sole and absolute discretion, we may require you to agree to an amended version of these Terms by providing notice to you at least (10) days in advance of effecting such amendment. If you do not agree with the amended version, you can choose to discontinue using the services, disable your account by emailing support@coinsave.io before such amended version becomes effective. It is your responsibility to regularly review the policies of Coinsave.
  2. You are a least 18 years of age, or the age of majority in your country.
    1. Have the full legal capacity to accept these Terms of Service and enter into a transaction involving Digital Currency.
    2. You must not be a resident or citizen of the United States of America or any territories of the United States of America.
  3. You are not acting on someone else’s instruction or any third-party.
  4. You accept that the purchase and sale of cryptocurrency (Bitcoin, Ethereum, etc.) involves risk. Due to the constant price fluctuations, you may increase or lose value in your assets at any time.
    1. You acknowledge that purchasing Bitcoin (or any other digital currency/service offered by Coinsave) involves risk and you will not hold Coinsave accountable for any gains or losses that you incur as a result.
    2. In no circumstance shall Coinsave be responsible for any loss that you incur.
  5. Coinsave does not provide, offer or exchange securities, investment contracts or any other form of financial instrument that may be considered by law to be a "security".
  6. Coinsave offers a marketplace for the buying and selling of Cryptocurrency. While we strive to ensure that marketplace is both fair and free, we you acknowledge that Coinsave has no responsibility for any losses that you incur as a direct or indirect result of the website or any of our services.
    1. Users agree that cryptocurrency prices are often unpredictable, and experience swings due to a variety of reasons, including government interference, market conditions and speculation.
    2. Coinsave does not set the current market price. The price of cryptocurrency units traded on the Coinsave platform result directly from buy and sell orders placed by other exchanges.
    3. Any trading decision based on information provided by Coinsave shall be the responsibility of the user alone. Coinsave assumes no responsibility for any action that is taken in the course of using the Coinsave website.
  7. Market information on Coinsave is not delayed. However, in the event of a network outage or similar situation, users acknowledge that Coinsave bears no responsibility for any delays.
  8. As a user of Coinsave, you acknowledge that Coinsave has no responsibility for any losses that you incur as a direct or indirect result of the website or any of our services.
    1. Coinsave is not a bank, and therefore is not protected by the Canadian Deposit Insurance Corporation (CDIC). Fundings, whether they be in a national currency or digital cryptocurrency are not protected by any government insurance policy.
    2. All account fundings are considered to be purchases of Coinsave credits. These are units that are used for the purposes of purchasing Bitcoin or other cryptocurrencies. Coinsave credits are NOT Canadian Dollars. Any notation of $, CAD, EUR or USD refers to an equivalent unit in Coinsave credits, which exist for the sole purpose of buying and selling cryptocurrencies and using Coinsave Services.
    3. Coinsave is NOT a financial institution, bank, credit union, trust, or deposit business. We DO NOT take Deposits. We exist solely for the purposes of buying and selling cryptocurrencies.
  9. It is the user's responsibility to secure his or her Coinsave account. Any loss that occurs as a result of negligent security practices, whether it be on the part of the user, or Coinsave, will not be the responsibility of Coinsave, its officers, directors, associates or employees.
    1. It is your responsibility to guard your password. Sharing your password with a third party constitutes a breach of this contract.
    2. The Coinsave website and any related service is provided "as is". We make no warranties, expressed or implied.
  10. The content and services provided by Coinsave are for informational purposes only and are not intended to provide legal, financial, tax, accounting or investment advice. We assume no liability for any information provided by our employees, directors, officers or affiliates, regardless of its accuracy. Any action taken by a user is their decision, and users absolve Coinsave of any liability for any outcome that may occur.
  11. Coinsave is based in Montreal, Canada. We comply with all local laws. It is the responsibility of the user to ensure that they are in compliance with their local laws.
    1. Any user that breaks any law in their jurisdiction of residence or nationality by using any service provided by Coinsave shall be liable for any damages incurred by Coinsave as a result.
    2. If buying and selling Cryptocurrency is not legal in your country, do not use Coinsave. Failure to comply with local laws may result in the loss of your account.
    3. In the event that Coinsave or its directors face legal action as a result of your actions, you agree cover any damages, including legal fees, that Coinsave incurs as a result.
    4. To the full extent permitted by applicable law, you hereby agree to indemnify Coinsave, and its partners against any action, liability, cost, claim, loss, damage, proceeding or expense suffered or incurred if direct or not directly arising from your use of Coinsave or its services, or from your violation of these Terms of Use.
  12. Coinsave has the right to terminate, close out or reverse an Online Order without notice to the User if:
    1. The User fails to make any payment in respect of an Online Order when due and in accordance with these Terms of Service; or
    2. The User materially breaches any of these Terms of Service or fails to comply with its obligations to Coinsave or is in breach of any statute, regulation, rule or guideline applicable to the User or CB; or
    3. It becomes or may (in the reasonable opinion of Coinsave) become unlawful for Coinsave to maintain or give effect to all or any of the obligations under the these Terms of Service or otherwise to carry on its business or if Coinsave is requested to close out an Online Order (or any part thereof) or Preload Withdrawal by any regulatory authority whether or not the request is legally binding or Coinsave, in its sole and absolute discretion, considers it desirable or necessary to do so for its own protection; or
    4. The User becomes unable to meet its obligations as they become due or has a bankruptcy petition presented against it or the User proposes a form of composition or arrangement to its creditors or the User ceases or threatens to cease all or part of its business; or
    5. Any of the events specified above or anything comparable thereto occurs under the laws of any applicable jurisdiction.
  1. You agree not to copy any information from the Coinsave website, without our permission, with the exception of the Press Package or Media Kit.
  2. In no event shall Coinsave or its associates, affiliates, or subsidiaries be liable for any damages, including damage for loss of data or profit, arising out of the use of the services of materials provided by Coinsave, even if Coinsave is negligent in any way.
  3. You attest that you are not a criminal, are not associated with any criminal activity, and that all funds that are sent to Coinsave are free from any criminal association, are not the proceeds of crime, and are not derived from any criminal activity.
  4. Although Coinsave tries to deliver you up to date market data such as quotes and charts the data is proved “as is” without any guarantee of it being the latest. The data may also have typographical errors, be incomplete and inaccurate. Coinsave will try to correct those mistakes on as soon as possible.
  5. Coinsave may provide links to external websites as references. These links are provided for informational purpose only without any guaranties pertaining to their accuracy, content and suitability of purpose. Those links do not constitute an endorsement of Coinsave in any kind and should be followed at the user's own risks.
  6. Access to Coinsave is provided on a best effort basis meaning that some interruptions are possible. These interruptions may be planned or not, full or partial. Coinsave will be providing advance notices for planned maintenance but will not be responsible for any damages or losses that an interruption of service of any kind may cause to you.
  7. You are prohibited from using this site to conduct any unlawful, fraudulent, false, abusive or suspicious activity in our judgement. If your account shows signs of unlawful, fraudulent, false, abusive or suspicious activity, we may close or disable actions to any account associated with your name, email address or account. We reserve the right to take any necessary legal action and you may be liable for monetary losses to us, including litigation costs and damages.
  8. You warrant that any and all of the personal information submitted as may be required, is accurate and authentic. Furthermore, you warrant to update the Company with respect to any changes in or of the information submitted to Company. Company may use or transfer your information to third party service providers for the purpose of providing you with the Services under the Site or the improvement thereof.
  9. You acknowledge that Coinsave performs inquiries to verify your personal information, whether directly or through the assistance of third party service providers in its attempt to prevent misidentification, fraud, suspicious activity or money laundering or any other forbidden activity and may take actions with respect to the outcome of such inquiries as it deems necessary. You hereby provide Coinsave with your authorization for such inquiries as aforementioned, including with respect to a query of your account information
  10. Coinsave site access is granted for your personal, non-commercial use only. You may not copy, redistribute, mirror, reproduce and modify the content of this website in any form without prior written consent of Coinsave. We reserve the right to deny access to anyone to this website for violation of any terms of these Terms of Service, which violation may be subject to legal action.
  11. You must provide any information required when creating a Coinsave Account or when prompted by any screen displayed within the Services. You represent and warrant that any information you provide via the Services is accurate and complete.
  12. Coinsave at anytime and in our sole discretion, refuse any trade submitted via the Services, impose limits on the trade amount permitted via the Services or impose any other conditions or restrictions upon your use of the Services without prior notice.
  13. If you have an insufficient amount of Funds in your Coinsave Account to complete an order via the Services, we may cancel the entire order or may fulfill a partial order using the amount of Funds currently available in your Coinsave Account, less any fees in connection with our execution of the trade.
  14. It is your responsibility to determine what, if any, taxes apply to the trades you complete via the Services, and it is your responsibility to report and remit the correct tax to the appropriate tax authority. You agree that it’s your responsibility to hold Coinsave harmless and you must determine if any taxes. You agree that Coinsave is not responsible for determining whether taxes apply to your trades or for collecting, reporting, withholding or remitting any taxes arising from any trades.
  15. Coinsave may from time to time establish links between the Platform and one or more web sites operated by third parties. Coinsave does not control such web sites and is not responsible for the contents of any linked site, any link contained in a linked site or any changes or updates to such sites. The existence of such links does not constitute an endorsement by Coinsave of the contents of such web sites or the operators thereof.
  16. Coinsave is the sole owner of the Platform, which includes any software, domains, texts, graphics, files and other content made available through the Platform.
  17. The Coinsave brand and the Platform are protected from unauthorized copying and dissemination by copyright law, trademark law, and other intellectual property laws. Without limitation, this means that you may not sell, export, license, modify, copy, distribute or transmit the Platform (or any part of it) or any material provided through the Platform without Coinsave’s prior express written consent.
  18. You should also apply caution when reviewing text messages and emails purporting to originate from Coinsave as SMS and emails are also vulnerable to phishing and spoofing and additional viruses. It is advisable that you log into your Account through the Site only and avoid using unauthentic communication advising you options to log in.
  19. You should verify all information before relying on it, and all decisions based on information contained on the Company Site are your sole responsibility and Company shall have no liability for such decisions.
  20. You may disable your account at any time by submitting your request to disable your Account at support@coinsave.io. No disabling fee shall apply, except that you will be responsible for fulfilling any outstanding payment obligations to the Company existing as of the effective date of termination and to settle any pending transactions. The Company reserves the right to suspend any pending transactions at the time of cancellation.
  21. Coinsave may, subject to its sole discretion disable the services refuse to open any user an account or terminate any use by you of the site.
  22. Upon any suspension, termination or cancellation of a transaction, Coinsave is under no obligation to allow you to reinstate such Transaction and may not provide you the same price or same terms as any canceled Transaction.
  23. In the event your Account is disabled by Coinsave, Coinsave may provide you with a notice. In addition, you acknowledge that Coinsave is not obligated to disclose any findings and information acquired Coinsave’s security and risk management procedures.
  24. Coinsave and its graphics, logos, icons and service names related to the platform are registered and unregistered trademarks or trade dress of Coinsave Services. They may not be used without Coinsave’s prior express written permission.
  25. All other trademarks not owned by Coinsave that appear in connection with the Platform are the property of their respective owner, who may or may not be affiliated with, connected to or sponsored by Coinsave.
  26. REFUNDS. DUE TO THE NATURE OF THE SERVICES THE SITE PROVIDES, ALL PURCHASES MADE ON THE SITE ARE NON-REFUNDABLE. You acknowledge that transactions executed are non-cancelable and you cannot change or reverse any transaction which was complete or which is pending.
  27. The abovementioned notwithstanding, Coinsave may endeavor to comply with a request from you to cancel a transaction on your account should Coinsave determine the cancellation feasible, all subject to Coinsave’s sole discretion and you will have no recourse or demands with that respect.
  28. Login Information Security. Your login information and password must be kept in strict confidence at all times. Compromise of your login information may expose your Account to unauthorized access by third-parties which may result in loss or theft of Digital Currency or funds from your Account, including linked accounts, such as your linked bank accounts and credit cards. In order to receive security alerts from Coinsave, you must update Coinsave with respect to changes in your email address and telephone number. At no event will Coinsave be held responsible for any damages or losses which you may sustain as a result of compromise of your Account login credentials due to no fault of Coinsave and/or failure to follow or act on any notices or alerts that we may send to you. Any suspected compromise of your login information should be immediately reported to Coinsave at support@coinsave.io.
  29. The price as displayed on the Site, will be applicable to each Transaction You execute using the Services (the "Price"). The applicable Price will be displayed prior to completing each Transaction. Company reserves the right to make adjustments to its Prices at any time as appearing on each Transaction.
  30. Each Coinsave fee including but not limited to buy/sell is subject to processing fees + the appropriate PST/GST.
  31. You warrant that you will comply with all applicable international economic and export sanctions and any requirement therein. Without limiting the generality of the aforementioned, you will not use the Services available on Coinsave if any of the following applies to you:
    1. You are a national or resident of any of the following countries Afghanistan, Angola, Algeria, Bangladesh, Bolivia, Burkina Faso, Burundi, Cambodia, Cameroon, Central African Republic, Chad, Colombia, Congo Democratic Republic, Côte d’Ivoire, Egypt, Eritrea, Ethiopia, Gambia, Guinea, Guinea Bissau, Haiti, India, Indonesia, Iran, Iraq, Israel, Kenya, Laos, Lebanon, Lesotho, Liberia, Libya, Madagascar, Mali, Mozambique, Myanmar, Nepal, Niger, Nigeria, North Korea, Pakistan, Palestinian Territory, Panama, Paraguay, Philippines, Sao Tome and Principe, Saudi Arabia, Sierra Leone, Somalia, Sri Lanka, South Sudan, Sudan, Syria, Tajikistan, Tanzania, Tunisia, Turkey, Ukraine, Uganda, Vanuatu, Venezuela, Yemen, Zambia, and Zimbabwe or any other country included in the United States embargo, UN sanctions, HM Treasury's financial sanctions regime (the "Restricted Territories") or you intend to distribute or provide the acquired Digital Currency or the Services to the Restricted Territories; or
    2. Your name appears on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Commerce Department's Denied Persons List, Unverified List, Entity List HM Treasury's financial sanctions regime (the "Restricted Persons") or you intend to distribute or provide the Services to any person of the Restricted Persons
    3. You are on prescribed Sanctions lists. We will, therefore, screen against United Nations, European Union, UK Treasury and US Office of Foreign Assets Control (OFAC) sanctions lists in all jurisdictions in which we operate
    4. At the moment Coinsave does not allow users to use the service from any country besides Canada. If a user-account is deemed to be from another country it is disabled and reviewed by senior management.
  32. If you are a Politically Exposed Persons (PEP) you may use Coinsave Services, but must identify as a PEP when signing up. You agree that Coinsave Services may occasionally use a third-party tool to identify if you or are Politically Exposed Persons/Head of International Organization (HIO). If you identify as a PEP/HIO at any point in the future after creating a Coinsave account, you must email: contact@coinsave.io about this change.
  33. Coinsave Services is based in Montreal, QC Canada. The Terms of Service shall be governed by and construed in accordance with the laws of the Province of Quebec without giving effect to any principles of conflicts of law. You expressly agree that the exclusive jurisdiction for any claim of action arising out of or relating to these Terms of Services or your use of the Site shall be filed only in the courts located in the province of Quebec in Montreal.
  34. If any provision in these Terms of Service should prove to be unlawful, void, or for any reason unenforceable, then such provision will be severed and replaced with a new provision that most closely reflects the intent of the original provision, and shall not affect the validity and enforceability of any remaining provisions. Coinsave’s failure to insist upon or enforce strict performance of any provision in these Terms of Service shall not be construed as a waiver of any right on its part.
  35. You agree that in the event you fund your Coinsave account with a payment method that is returned unpaid due to non-sufficient funds being available in your account you agree to pay Coinsave Services $25.00.
  1. Pre-Authorized Debit Agreement:
    In order to use Coinsave’s EFT Payment Services to debit your bank account. This Pre-Authorized Debit Agreement (this “Authorization”) constitutes your agreement and authorization for Coinsave Services to debit your bank account.
    1. You acknowledge that this authorization is provided for the benefit of Coinsave and your Financial Institution and is provided in consideration of your Financial Institution agreeing to process all debits against your bank account(s) in accordance with the Rules of the Payments Canada.
    2. You hereby authorize Coinsave Services to draw on the settlement account for purposes of (a) funding a reserve account to secure the performance of your payment obligations, (b) processing refunds or transaction reversals or chargebacks, or (c) collecting any and all amounts owed to Coinsave under any agreement between you and Coinsave (a “debit” or “PAD”). In particular, you agree that if any payment is dishonored by your Financial Institution for any reason, Coinsave Services shall be entitled to issue another debit in substitution for the dishonored debit. Coinsave Services shall be under no liability whatsoever caused by a dishonored debit.
    3. You may cancel this authorization at any time by closing your Coinsave Services account. You acknowledge that, if you revoke this Authorization, you must close your Coinsave Account or else Coinsave Services may do so. Coinsave may debit the settlement account up until 30 days after your cancellation or revocation.
    4. You acknowledge that your agreement to this Authorization with Coinsave Services constitutes delivery of this authorization by you to Coinsave Services and your Financial Institution.
    5. You acknowledge that the debits authorized pursuant to this authorization are for personal purposes.
    6. The details of the settlement account that Coinsave Services is authorized to draw upon are set out in your Coinsave acount. You may only change the settlement account that by removing your bank account from your Coinsave account and adding a new one.
    7. You acknowledge that your Financial Institution is not required to verify that (i) a PAD has been issued in accordance with the particulars of this Authorization or (ii) any purpose of payment for which the PAD has been issued has been fulfilled by Coinsave Services as a condition to honoring a PAD issued on your settlement account.
    8. Even if you cancel or revoke this authorization, certain provisions of the Payment Terms between you and Coinsave Services survive and remain in effect in accordance with their terms. To obtain a sample cancellation form, or for more information on your right to cancel a PAD Agreement, you may contact your Financial Institution or visit https://www.payments.ca.
    9. You have certain recourse rights if any debit does not comply with this authorization. For example, you have the right to receive reimbursement for any debit that is not authorized or is not consistent with this authorization. To obtain more information on your recourse rights, contact your Financial Institution or visit https://www.payments.ca.
    10. A PAD may be disputed by you only if (i) the PAD was not drawn in accordance with this Authorization or (ii) amounts were drawn after this authorization was revoked. In order to be reimbursed, you acknowledge that a declaration must be completed and presented to your Financial Institution holding the settlement account up to and including 10 business days after the date on which the PAD in dispute was posted to the settlement account. You acknowledge that, after such 10 business day period, a claim that the authorization was revoked or any other dispute of a PAD is a matter to be resolved solely between you and Coinsave.
    11. You acknowledge that you understand the terms hereof and you accept and agree to participate in this PAD arrangement with Coinsave Services.
    12. You acknowledge that Coinsave Services may assign this authorization, whether directly or indirectly, by operation of law, change of control, or otherwise, by providing at least 10 days prior written notice to you.
    13.     14. You consent to the disclosure of any personal information that may be contained in this authorization to Financial Institutions at which Coinsave Services maintains its account to be credited with the PADs as far as any such disclosure of personal information is directly related to and necessary for the proper application of the Rules of the Canadian Payments Association.
  1. Privacy Policy: You also agree with our current privacy policy
